Defending Against Sexual Battery Charges

The simple accusation of sexual battery can seriously damage your reputation, both personally and professionally. If convicted, you can expect hefty fines, sex offender registration and a long prison term, serving time with the state’s worst offenders. Do not assume that these allegations will simply fade into the night. Mere accusations are enough to result in your arrest and prosecution. Don’t risk your freedom and future by working with an inexperienced attorney.

At Hayes Ruemmele LLC, we have extensive experience defending clients against sex crime charges, and we fully understand how to build a compelling defense case that can win at trial. Whether you need a tough negotiator or a seasoned courtroom litigator, our track record shows we have the skills to handle your case effectively.

What Is Sexual Battery?

Sexual battery is similar in nature to rape but carries far less severe penalties. Unlike rape, a sexual battery charge does not require an allegation of “sexual conduct” but instead only requires a prosecutor to prove an unlawful touching occurred that was intended to satisfy a sexual desire. Sexual battery is codified under Indiana Code 35-42-4-8 and can be either a level 4 or level 6 felony. Under certain circumstances, sexual battery can be entered as a misdemeanor, but, in all cases, it requires an offender to register as a sex offender for at least 10 years. Sexual battery is sometimes referred to as a lesser included charge of rape.
